Truvada Lawsuits

What is Truvada?

Truvada is a drug prescribed in addition with other therapies for treating Human Immunodeficiency Virus (HIV). If left untreated, HIV can develop into Acquired Immunodeficiency Syndrome (AIDS). So, drugs used to treat HIV—Truvada, Viread, Stribild, Atripla, and others—fulfill a big need in the medical marketplace for consumers with HIV. Pharmaceutical company Gilead Sciences Inc., developer of all the TDF medications currently on the market, received FDA approval for Truvada in 2004. Truvada sales reach up into the billions of dollars annually.

As a mixture of emtricitabine and tenofovir, Truvada works in treating HIV by decreasing the virus level present in the body to support patients’ immune systems. Though no cure currently exists for HIV or AIDS, Truvada helps patients lower their risk of developing complications related to HIV. Truvada is typically used to treat HIV in adults and children who are at least 12 years old and weigh at least 37 pounds, but can also be used in children who weigh from 55 to 77 pounds and take certain additional HIV medications. Truvada can also be used for Pre-Exposure Prophylaxis (PrEP) or protecting oneself before coming into contact with HIV-1 through sex practices.

What Went Wrong?

Allegations assert Gilead Sciences knew Truvada’s toxicity was too high and still marketed the drug knowing a safer alternative was available. The less toxic option, tenofovir alafenamide fumarate (TAF), was released years after Truvada and other TDF medications were on the market. Lawsuits allege Gilead knew TDF was more toxic than TAF, and TAF could be given at a lower dose with the same effectiveness as TDF. However, plaintiffs argue Gilead held out on marketing TAF until the patents on their TDF drugs ran out to increase company profits. As of June 2018, Truvada carried a whopping list price of $2,000 for a 30-day supply. 

While TDF dug patents began expiring last year, TAF drugs have patent protection until 2032. The California-based company shelved TAF in 2004 and did not start selling TAF drugs until over 10 years later in 2015. Because of the delay, TDF drug dependents took a drug too toxic to be safe and developed severe health complications. Lawsuits allege Gilead manufactured a too toxic product and failed to adequately inform consumers of all the serious risks of taking Truvada.

Truvada Side Effects:

Injuries include acute kidney injury, chronic kidney disease (CKD), renal failure, end-stage renal disease (ESRD), and renal insufficiency/impairment.
Problems include osteoporosis, bone breaks/fractures, bone density loss, tooth loss.

New Studies Reveal Toxicity

Current research continues to support the allegations of Truvada’s over-toxicity. A recent study discovered side effects of Truvada and similar HIV drugs may increase patients’ risk of developing HIV-Associated Neurocognitive Disorder (HAND). 

According to a study published in the European Journal of Pharmacology in February 2019, Chinese researchers discovered that more than half of HIV patients who take viral suppressant medications with tenofovir disoproxil fumarate (TDF) in them will develop HAND. HAND impacts mental and motor functions, the effects increasing in severity as time goes on. This often signals that a patient is starting to transition from being HIV-positive to being fully diagnosed with AIDS. While the symptoms seem innocuous at the time, the later stages of HAND can render patients into an almost vegetative state.

The motion brought forward states that “All plaintiffs allege that Gilead intentionally designed its TDF drugs to be unreasonably and unnecessarily toxic to patients’ kidneys and bones, while it purposefully withheld a safer design of the drugs for more than a decade in order to make more money.” These cases hope to be centralized before one judge in the northern District of California, conveniently where Gilead’s headquarter resides.
