3M's Dual-Sided Combat Arms Earplugs are wreaking havoc on unknowing U.S. military members, many of which are currently serving in active combat zones. AVA Law Group currently investigates cases on behalf of U.S. military service members issued defective Combat Arms Earplugs over the last decade. If you or a loved one endured hearing problems because of the dangerously defective earplugs, you may be entitled to compensation.

3M Combat Arms Earplugs Background

From 2003 - 2015, the U.S. military distributed Dual Sided 3M Combat Arms Earplugs to thousands of unknowing American soldiers. This includes those who served in combat zones from 2003 - 2015. The earplugs were originally manufactured by Aearo Technologies, which was later acquired by corporate behemoth 3M Company. However, reports show that these dual ended/reversible earplugs may have been dangerously defective because of a design flaw. In turn, the defect contributed to the hearing difficulties and suffering of service members issued the earplugs. While 3M recently recalled the earplugs, innocent service men and women still experience painful consequences from using the harmful earplugs they placed their trust in as they served our country.

Defective Earplug Design

Reports reveal that 3M failed to disclose a crucial design flaw potentially known as early as 2000. This was three years before the military began distributing the potentially defective earplugs to men and women serving the United States across the globe.

Further investigation quickly revealed the defect: a too short, earplug stem. The short stem caused the earplug to not fit properly nor effectively into soldiers' ear canals.

The original design meant to block out certain loud noises, protecting soldiers' ears from the percussive sounds of gunshots, explosions, etc. However, the short stem subjected unaware military service members to inadequate hearing protection. Branches of the military impacted by these hazardous earplugs include the Army, Navy, Marine Corps, Air Force, and Coast Guard, including the reserves.

Dual-Sided 3M Combat Arms Earplugs Checklist

3M's Dual-Sided Combat Arms Earplugs are distinguishable by the fact that they are dual sided and dual colored. While the official description says they are olive green on one end, some military members remember that color as black instead.

  • ONE END: Green/olive color without a hole
  • OTHER END: Yellow with a hole
  • BOTH ENDS: Three flanges

Military Suffering from Hearing Problems

Soldiers impacted by the design flaw report experiencing hearing difficulties, partial or complete hearing loss, and tinnitus.

The Mayo Clinic defines tinnitus as "the perception of noise or ringing in the ears". Many soldiers seeking legal help for the earplugs scandal experience severe tinnitus due to the flawed earplugs. To soldiers' dismay, their enjoyment of life is significantly impacted by the constant and insufferable ringing they hear.

In a recent story by CBS News, two veterans suing 3M suffer from tinnitus and desperately want to achieve justice for themselves and their fellow soldiers enduring hearing complications from the earplugs. David Henderson, one of the two military men filing lawsuits against 3M, related the devastation of his condition to CBS News:

"What is quiet? What's peace? I know for me personally, I don't have it. All I hear is ringing if there's no noise around me....If I do not have noise around me, it's maddening. It is torture."

More and more lawsuits pour in to the federal court system, showing how far the 3M earplug scandal has reached and traumatically impacted military members. If you or someone you know served in the US military between 2003 and 2015 and experienced hearing problems caused by ineffective earplugs, now's the time to act! In July 2018, the Department of Justice reached a $9.1 million dollar settlement with 3M over the Dual Sided Combat Arms Earplugs, and the number of lawsuits steadily increases over the defective, reversible earplugs.
